Social Media Login Data. We may provide you with the option to register using your existing social media account details, like your Facebook or X account. If you choose to register in this way, we will collect certain profile information as described in “HOW DO WE HANDLE YOUR SOCIAL LOGINS?” below.
If you use our application(s), we may collect information such as device access (for example, storage), device data (such as device ID, model and manufacturer, operating system and version, and application identifiers), and push notifications (which you can turn off in your device settings). This information is primarily needed to maintain the security and operation of our application(s), for troubleshooting, and for internal analytics and reporting.
In Short: Across our applications — Ember Sports Hitting Analyzer, Ember Sports Pitching Analyzer, and Ember Sports VR — we collect the training and performance data you generate, your subscription status, and limited diagnostic information.
Performance and training data. The purpose of our applications is to help you measure and improve your performance and track it over time. Depending on the application, we collect and store performance data such as swing and pitch metrics, pitch-recognition and umpire-call accuracy, scores, and training-session history. This data is stored on your device and may be synchronized to your account on our backend, hosted on Amazon Web Services (“AWS”), so it is available across sessions and devices.
Subscription and purchase information. Some applications are free to download and offer optional or required subscriptions. Subscriptions are purchased through the applicable app store or platform (for example, the Apple App Store, Google Play, or the Meta Horizon Store), which processes your payment. We receive your subscription or purchase status to grant or restrict access; we do not collect or store your payment card information.
Analytics and diagnostics. Subject to your consent, we use Google Firebase Analytics and Crashlytics in our applications to collect aggregated, pseudonymous usage events and crash diagnostics. You can enable or disable analytics at any time in the application’s settings, and analytics is disabled for users identified as minors.
In Short: Some information — such as your IP address and/or browser and device characteristics — is collected automatically when you use our Services.
We automatically collect certain information when you visit, use, or navigate the Services. This may include log and usage data, device data, and (on the website) similar technical information, primarily needed to maintain the security and operation of our Services and for internal analytics and reporting. In our applications, diagnostic and analytics data is collected through the Google Firebase SDKs, and only with your consent.

Our Services may offer the ability to register and log in using third-party social media account details (like your Facebook or X logins). Where you choose to do this, we will receive certain profile information from your social media provider, which may include your name, email address, friends list, and profile picture, as well as other information you choose to make public. We will use the information we receive only for the purposes described in this Privacy Notice. We do not control, and are not responsible for, other uses of your personal information by your social media provider.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice. In practice, we retain your account and performance data for as long as your account remains active. You may request deletion of your account at any time from within the application; upon such a request, we will delete or anonymize your personal information, except where a longer retention period is required or permitted by law. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if that is not possible (for example, because it has been stored in backup archives), securely store it and isolate it from further processing until deletion is possible.

We have implemented appropriate and reasonable technical and organizational security measures — including encryption in transit, access controls, and secret management — designed to protect the security of any personal information we process. Our applications are designed for athletes of varying ages and may be used by minors, including children under 13. We do not knowingly collect or retain personal information from children under 13. Where a user is under 13, we do not retain personal data about that user, and analytics and diagnostic collection is disabled. We do not knowingly sell personal information belonging to minors. If a child under 13 uses the application, it should be with the involvement of a parent or guardian. If you believe we have inadvertently collected or retained personal information from a child under 13, please contact us at info@embersports.com and we will take reasonable measures to delete it.

In some regions (like the EEA, UK, Switzerland, and Canada), you have rights under applicable data protection laws, which may include the right to request access and obtain a copy of your personal information, to request rectification or erasure, to restrict processing, to data portability, and to object to processing. Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals. If a standard is adopted that we must follow, we will inform you in a revised version of this Privacy Notice.

We retain each collected category for as long as your account is active, as described in Section 6. We do not sell personal information or share it for cross-context behavioral advertising, and we have not done so in the preceding twelve (12) months.

You have the right to request access to the personal information we collect from you, details about how we have processed it, to correct inaccuracies, or to delete your personal information; you may also withdraw consent. To request to review, update, or delete your personal information, please contact us at info@embersports.com or use the controls in your account or application settings. We will respond consistent with applicable law.
This addendum supplements the Privacy Notice above and applies specifically to Ember Sports VR (also known as Apogee Virtual Pitch Trainer) when used on Meta Quest devices. It describes information made available to us through the Meta Horizon Platform.
When you launch Ember Sports VR, we use the Meta Platform SDK to confirm that you are entitled to the application (an anti-piracy check) and to determine your subscription status. Through these features we receive from Meta an app-scoped user identifier and your subscription and entitlement status, including the relevant plan identifier (SKU). We do not receive your Meta account password or payment card details.
Ember Sports VR is free to download; full content requires an active subscription purchased through the Meta Horizon Store, which processes your payment. We store your subscription status, term, and SKU to grant or restrict access and validate purchases with Meta. We do not store payment card information.
To render the experience and compute your results, the application processes headset and motion-controller position and motion data in real time during play. This data is used in-session to operate the application and to derive your performance metrics; we do not retain raw motion streams beyond what is necessary to produce those results. The application does not access the headset microphone or cameras, and we do not collect audio or camera imagery.
We share information with Meta Platform, Inc. for the entitlement, subscription, and purchase purposes described above. Meta independently controls data you provide directly to it under Meta’s own policies. Your use of the Meta Quest device and the Meta Horizon Store is governed by Meta’s privacy policy and terms.
